This article seeks to analyze the Brazilian electoral law through popular choice, specifically electoral systems and their relationship with the people and with democracy, since such concepts vary according to the place and time in which they are intended to be defined. From this perspective, democracy is an instrument of enormous importance not only in the political context, but also in the social context, as it is present in countless ways in everyday life. With the definition of the role of the people within democracy, of what democracy is for the people and what political representativeness exists in this relationship, we have the formation of electoral systems for the choice of candidates who represent the voters. Thus, what is intended to be understood by the bibliographical research carried out is the way in which the electoral systems currently used reflect democracy and the people, seen here as the citizen/elector who exercises it, since voting in an open list and the methods applied to elections, they end up not reflecting in a crystalline way the choice of the majority in the light of democracy.
