It is not new that the international community calls to action and responsibility the main political and social actors for the discussion and adoption of environmental safeguard measures. Brazil has for years strived to become an active voice in environmental governance, but in recent years it has put aside its protagonism in this area. To this end, the Paris Agreement was responsible for developing a new system of voluntary participation by the parties through the Nationally Determined Contributions. A new legal order makes new paradigms arise, in this sense, it was sought through exploratory research in physical and electronic media, to verify whether the international community can hold a State responsible for non-compliance with the Paris Agreement. In conclusion, we highlight that based solely on the Paris Agreement, there is no possibility of holding a State party responsible for non-compliance with the agreement, thus being at the mercy of climate diplomacy established between the various international actors part of the international community. Active and inspecting citizenship, internal and external, has a fundamental role in compelling the parties to, at least, strive to achieve goals through public policies aimed at mitigating climate effects.
