The contrary between the importance of crime scene expertise and the regulations of ordinance n. 085 GABS/SSP/2019

The importance of local crime expertise in the preservation and analysis of traces to identify suspects and establish the materiality of the crime is highlighted. This article presents a brief history and evolution of criminal expertise, its function in the justice system, the role of experts, scientific and technological advances. Definitions of criminalistics and criminal investigation are explained, emphasizing that the first encompasses investigation techniques, while the second is the work of experts in the analysis of traces. Ordinance N° 85 of the Public Security Secretariat of Santa Catarina also presents, along with the research objectives, which evaluates the coherence of this regulation with the importance of expert evidence and the need for expertise at crime scenes, considering that Ordinance N° 85 I disagree that although forensics is essential in many cases, not all facts will be the subject of this type of investigation, as the decision to activate or dismiss a forensics team will depend on the specific characteristics of each occurrence, with priority being given to the most serious and relevant cases. However, dismissing forensics in less serious situations can present risks, such as the loss of important documents and the lack of adequate analysis of the crime scene, even in apparently simple cases. Therefore, it is argued that dismissing the forensic team should be applied with strict criteria so as not to compromise the integrity of the investigations. Because criminal expertise continues to be an essential tool for seeking justice and ensuring public safety, despite the need to optimize resources.
