Abstract

Considering article 226 of the Code of Criminal Procedure, this article questions the credibility of the recognition of people carried out through photographs in Brazil, an analysis of this procedure is carried out in view of several cases where distortions or mistaken influences were observed, either by illusion of false memories or by the punitive selectivity implanted in society. In addition, it seeks to show possible ways that can improve this important jurisdictional method, such as the decision issued by Minister Rogerio Luiz Schietti of the STJ, which set a precedent for changes in the subject. Procedures that until then were not followed began to have indispensable status. The objective is to demonstrate the relevance of this theme and the risks of injustices, which may have serious consequences, such as the imprisonment of innocent people.
