In the present research, freedom of expression and hate speech will be addressed. With the development of this research, we seek to bring up the possibility of this fundamental right of freedom of expression, being relativized in the face of another fundamental right, or if society can use this right to exempt itself from its attitudes, without any tolerance. Whether it is possible to have restrictions. The method used was the Deductive, the study was developed through bibliographic research, using indoctrinators and other scholars in the area. The result will show in general what each of these rights discussed is about, the limits and restrictions that may be applied in certain cases, the influence of social media, as well as the understanding of the Higher Courts. Freedom of expression is an indispensable fundamental right for the individual and society, but it is extremely important to emphasize that it can be restricted and limited, not being an absolute right, which can be used without any care and responsibility, when in collision with others. fundamental rights such as the right to honor, privacy and human dignity.
