Abstract

The business activity causes several conflicts to emerge in daily life, resulting in the need for an effective result through a due legal process that meets the interests of the parties. However, it seeks to access justice through the Judiciary, which are outdated, not quick, and, therefore, do not satisfy the interests of those involved. In effect, self-composition means for resolving conflicts arise, especially in the Corporate field. Among others, there is mediation or business conciliation. As a cordial method of disputes, not only to resolve them, but to transform them, enabling the parties to be protagonists of their own interests. This study aims to present business mediation and conciliation as adequate conflict resolution mechanisms in order to better clarify the interpersonal relationships of the parties and effectively resolve the dispute. In this tone, the deductive approach method is used, with a view to mediation or conciliation being a form of adequate treatment of business conflicts. In addition, mediation and conciliation contribute to the judicial system, as a faster and more transforming solution. Finally, business mediation and conciliation provide significant benefits for solving disputes in Business Law, prioritizing a faster method with free expression by the parties, which provides better quality in obtaining justice.
