Abstract

The proposed article aims to understand the effectiveness of Law 10.826 / 2003, better known as the Disarmament Statute, with regard to the rates of murder by firearms since its implementation in Brazil. After being sanctioned, the Federal Senate enacted a referendum that consulted Brazilian citizens on October 23, 2005, whether the sale of firearms should be banned in Brazil. Eighteen years after the Law on Arms, society's questioning about the Statute's legitimacy in the face of the sovereign popular will has been growing, as well as its usefulness to curb crime, due to the statistics of violence committed in the country.
