Abstract

The purpose of this article is to examine the investigative method of police infiltration into criminal organisations and the limits to be imposed on agents as infiltrators, since non-compliance with the limits imposed can end up harming and causing nullity to the criminal proceedings that use the evidence thus obtained. It also analyzes the legislative aspects, the first and best known criminal organizations born in Brazil and other investigation methods brought by Law n. 12,850/2013. Thus it is asked: What are the limits imposed on the undercover agent to obtain lawful evidence?. Regarding the methodology, the deductive method is used, through the technique of bibliographic research, based on the pertinent legislation and doctrines.
