ways of punishing the alienant against Law n. 12.318/2010

Abstract

Through the breakup of a loving relationship, conflicts can arise between couples who have children, since it remains a parental bond. With this, unresolved situations among former prisoners can generate reflexes in children. In this context, there is the practice of parental alienation, which consists of a series of behaviors committed by the alienating parent, who tries to break any bond of the infant with the other parent. In this sense, in order to promote the well-being of children, adolescents, as well as the family nucleus, Law No. 12,318 of 2010 aims to mitigate any alienating acts. From this, the objective of this research is to verify the efficiency of preventive and punitive means for such situation present in the legislation. For this, it is based on a bibliographic and documentary theoretical-methodological contribution. When considering the results obtained, it is observed that Law n. 12,318 of 2010 is efficient in mitigating the practice of parental alienation and rebalance the family bond.
