the employment contract of the professional soccer athlete according to the Pelé Law

This study highlights the features and peculiarities of the special work contract of the professional soccer athlete with the club which hires him. The legal relationship in the scope of Labor Law has different forms of performance, the athlete being the main focus of this article, however, in order to analyze the characteristics of this type of work, it is necessary to understand how a legal relationship is composed and a labor contract within the scope of Labor Law, as well as constitutional bias in the form of principles, ensuring that it is fair for both parties that compose the employment relationship. However, it seeks to analyze, in practice, how the Lei Pelé is applied in contracts and in daily situations of an athlete, such as its use of image rights or even the sanctions in case of non-compliance with a legal determination with the consequent removal from training. Finally, an attempt was made to elucidate through jurisprudential understanding how a case involving different claims by club and professional athlete is analyzed in practice.
