Criminal law of the enemy in brazilian legal order

This article aims to discuss the thesis idealized by Günther Jakobs, who created the Enemy’s Criminal Law. The aspects approached by Jakobs concluded that his theory is incompatible with a State of Law, due to its repressive aspects and, mainly, the suppression of rights and guarantees, affecting considerably the human being dignity. The survey looked forward to answering the following legal-social question: Are there fragments of the Enemy’s Criminal Law in the Brazilian Legal System? And the answer was conclusively positive. Although the Juridical Order of the Country has the Federal Constitution of 88 as its stigma, full of guarantees and principles, even some of them being incompatible with Jakobs’ ideias, there are influences of this theory applied in Brazil.
