The article aims to analyze the intervention of the Public Defender introduced by art. 554, § 1 of the CPC, in light of the constitutional objectives of reducing social inequalities and the right to access to justice. First, a brief historical effort is made in order to identify the relationship between property and social inequality, and then to reflect to what extent this scope is related to the functions of the Public Defender's Office. In a second topic, we analyze the obligation of binding the Public Defender's Office in light of the obstacles to access to justice provided by Boaventura de Souza Santos.
Keywords: Public Defender. Possession. Property. Custus vulnerabilis. Access to justice.
