The concept of human dignity and human rights

Abstract

This article intends to bring a discussion about the concept of human dignity and human rights. Our objective will be to reflect on the concept of human dignity and its implications in the elaboration of human rights and in the current discussions on this theme. In order to delimit our analysis, we used two authors: Habbermas and Forst. Initially, we will clarify the differences between Morals and Law, and then introduce the issue of dignity and human rights, as well as the public sphere as a space for justification. We will defend the concept of human dignity as a basis for criticism in relation to the problems related to human rights that society faces. At the end, we will present some pertinent considerations for the discussion and how this debate can contribute to the expansion of human rights and the guarantee of a more just society.
