The benefit of continuous service provided for in the Social Assistance Organic Law and the reasonable duration of the process

The general objective of the study was to present the legal aspects of the Benefit of Continued Provision provided for in the Organic Law of Social Assistance and under the perspective and reasonable duration of the process. It is understood that the Benefit of Continuous Provision (BPC) is characterized by the fact that it is an assistance benefit provided by the National Institute of Social Security (INSS), having its prediction through the Organic Law of Social Assistance (LOAS), Law nº 8.742, of December 7, 1993, which aims to guarantee a monthly minimum wage for the elderly aged 65 or over or disabled people of any age. Methodologically, the study consisted of bibliographical research, which provided an analysis of the main theories of the subject studied, together with the approach methodology understood by the deductive method. It is concluded that the Benefit of Continued Provision (BPC), which after studying the legal intricacies of this benefit, for greater transparency and speed of its concession, is managed with extreme responsibility in terms of implementation, coordination, regulation, financing, monitoring, as well as a periodic assessment of those who are already beneficiaries together for new benefit requests.
