Environment protection and socio-environmental diagnosis as a tool for regularization of consolidated urban areas

With this work, the objective is to understand how the socio-environmental diagnosis can serve as a mechanism to promote the right to decent housing. It seeks to research on the regularization, from the socio-environmental diagnosis and the municipal legislative competence, of urban areas already consolidated that disrespect the minimum distance in the surroundings of water courses. Decent housing is a fundamental right provided for in the Federal Constitution and ends up on a collision course with environmental protection, also a constitutional principle. From the consideration, we seek to ensure decent housing with minimal damage to the environment. The area covered by the research was the Municipality of Rio Negrinho, which began its socio-environmental diagnosis in 2018 and is in the process of being concluded. The approach is qualitative, with a deductive method, with bibliographic research, documental research and interviews as the main tools. The results indicate that, although the diagnosis is still in progress, the completed steps indicate several areas that can be regularized.
