Freedom of expression x hate speech

The article brings a discussion about freedom of expression and hate speech, having as research problem the following question: to what extent is it possible to distinguish freedom of expression from hate speech without characterizing censorship? The justification that allows the approach of this theme takes into account the fact that, currently, it is possible to see more and more individuals exercising their right to express themselves freely. Social media has established itself as a vital vehicle for venting thoughts and opinions. The research carried out is of the descriptive type of bibliographic criterion. The method used for the production of this article is the hypothetical-deductive method. Freedom of expression has priority in Brazilian democracy because it is a prerequisite for the enlightened exercise of other rights and freedoms. Removal of circulation material constitutes censorship in all circumstances and is only permitted in extreme cases. Therefore, generally, the conflict between freedom of expression and personality rights must be resolved through correction, right of reply or civil damages.
