Abstract

This article discusses the possible characterization of civil liability for emotional abandonment. The family environment is of immense importance in the development of children and adolescents, under the responsibility of their parents. It seeks to understand from the beginning how a family occurs and how a family is formed from the perspective of Brazilian law, as well as what the duties of parents are during the upbringing and development of their children from the perspective of Brazilian law. In addition, the institute of civil liability is listed throughout history and how it is characterized in the specific case, whether for any violation or civil tort, as well as how it is presented and inserted in Family Law in what it concerns affective abandonment and a possible responsibility applied to parents who do not establish bonds of affection with their children. At the end, concrete cases of Brazilian jurisprudence are analyzed regarding the understanding of civil responsibility for emotional abandonment in the process of raising children.
