Abstract

Family life causes several conflicts to emerge day by day, bringing the need for an effective result through a legal process that meets the interests of the parties. But, currently, it seeks to access justice through the Judiciary. It is well known that the judicial means are out of date, and, therefore, do not satisfy the interests of those involved. In effect, self-composing means for resolving conflicts are born, especially in the family field. Thus, family mediation emerges. Being a cordial method of litigation, not only to resolve them, but to transform them, enabling the parties to be protagonists of their own interests. The present study aims to present family mediation as an appropriate conflict resolution mechanism in order to better clarify the interpersonal relationships of the parties. In this tone, the deductive approach method is used, in order for mediation to be a form of adequate treatment of family conflicts. In addition, mediation contributes to the judicial system, as a faster and more transformative solution. Finally, family mediation brings significant benefits for resolving disputes in Family Law, prioritizing a more humanistic method that guarantees, with more quality, the attainment of Justice.
