The purpose of this article is to analyze the arguments of the STF ministers in the judgment of HC 126.292, regarding the compatibility between the constitutional principle of the state of innocence and the early commencement of the sentence resulting from a conviction in a second degree of jurisdiction. . Kelsen's Normative Frame Theory and Alexy's Phatic Support Theory were used as theoretical references for understanding the divergences arising between the Supreme Ministries in this decision. Tensions were found between positivist and post-positivist points of view in divergent votes, leading to a divided and contradictory final decision. The method used was deductive.
