The present research relates some concepts worked by Giorgio Agamben with the question of criminalizing selection. The idea of ??a state of exception in which there is a suspension of the legal system has been associated with the management of bare life, which, in turn, is carried out by biopolitical instruments of control. For the present research the inductive-dialectic method was used. Homo sacer was identified as the object of the criminalizing selection, by determination of the sovereign, who articulates his Genius so that the individual is not able to respond to his desires.
Keywords: Bare life. Homo sacer. Criminal selectivity.
