Abstract

The notion of historical and cultural heritage is linked to goods, materials or immaterials, which encompass the nation or are circumscribed to certain regions. Certain locations have the aptitude to gain legal protection applicable to historical and cultural. This article aimed to evaluate the possibility of characterizing the Santa Emídia Cave – Bom Sossego Rural Community/ Irineópolis-SC, as historical and cultural heritage in view of the current legislation that governs the matter. It was found that the cave is linked to the tradition of São João Maria and is linked to facts that occurred in the Sertanejo do Contestado Movement (Contestado War). These data are pressing, especially due to the expansion of reforestation of pinus elliottii that surrounds the cave, which significantly changes the landscape and hinders the pilgrimage to the site. Thus, it has the necessary characteristics to be declared, as long as there is action in this regard by the public authorities.
