Comparative analysis of name origin protection systems in Brazil and France

This paper aims to analyze the particularities of the French and Brazilian systems of protection of names of origin, identifying structural and organizational aspects of each country. For this study we conducted documentary and bibliographic researches, presenting updated information from the databases of the National Institute of Origin and Quality (INAO) in France and the National Institute of Industrial Property (INPI), in France and Brazil, on GI requested and granted in both countries. The results focused on the discussion of the main characteristics, presented in a comparative way. In this study it was possible to highlight two distinct realities, both structural and organizational. While in France, the protection of origin names involves two public institutions, in Brazil it is the responsibility of a single institution. At the same time, differences were identified in the conduct of the steps to obtain the registration of the name of origin in both countries, being considered a centralized system in France, supported by the competent public institution before and after the granting of registration.
